There are many reasons for not paying child support. Some are valid, some are not. A very active and vocal campaign is taking place to incarcerate and generally make life miserable for non-custodial parents who are behind. The salary of the non-custodial parent and the "Earning Capacity" are used to decide how much support is paid. The "Earning Capacity" of the custodial parent is not part of the equation nor is accountability. Support payments continue to accumulate if you are in jail because of support. At the time of release the arrearage has increased and playing catch up without a job is not easy. Most of the time your job is not waiting, you usually lose your job when you go to jail. Throughout this process they totally ignore the children of second families. Their needs are not relevant, living expenses are not considered when support is calculated. No matter why support is not paid, you do not have to look far to find advocates for the parent not receiving support.
There are many reasons for denying visitations. Some are valid, some are not. The difference is there are no campaigns and cries of outrage at denial of visitations? Where is the legislation to bring justice to self-centered parents who will make visitations so difficult many parents give up? How do you make up time lost with a child? How do you make up all the "firsts" in a child's life that have been missed? In later years, how do you adequately explain to a child why you were an absentee parent, they think you did not care.
The non-custodial parent is subjected to all sorts of indignities, parenting classes, drug testing, they require psychological evaluations and appropriate accommodations, even if the room is not used. The non-custodial parent has to prove repeatedly that they are fit to spend a few hours a week with their children. The rules only apply to the non-custodial parent.
The custodial parent does not have to answer to anyone, they do not have to provide separate sleeping arrangements, the everyday routine is not questioned and the quality of life being provided is irrelevant. They do not take the parenting skills of the custodial parent into consideration, even if it borders on abuse. The custodial parent has all the time in the world to create a negative attitude and make the child feel quilt for having a good time at a visitation.
The court system is not set up to address visitation issues, the paperwork all relates to support, if visitation is the problem they adjust the form. Visitation is a civil matter, law enforcement cannot help. Court orders stapled on top of each other do not guarantee visitations. If the custodial parent decides the non-custodial parent is not going to see their child, they will not.
Children have the right to financial and emotional support. It really is time to put the best interest of the children first when relationships end. Children have the right to grow up with both parents.
